- Three bipartisan bills have been introduced in the US House of Representatives to make Chinese data security threats to smartphones more apparent.
- The first bill, the TELL (Telling Everyone the Location of Data Leaving the US) Act, would require anyone who maintains a website or distributes a mobile app with information stored in China to disclose the data storage. The Federal Trade Commission would be responsible for enforcing the disclosure requirement.
- The second bill, written by Reps. Kat Cammack and Darren Soto, would require anyone selling or distributing a mobile app to disclose if the app is banned from government devices. A maximum penalty of $46,517 per violation would be imposed by the FTC on anyone who fails to meet the obligations under this bill.
- The third bill, the Internet Application Integrity and Disclosure Act, would force any entity owned by someone in China or by the Chinese Communist Party to disclose the Chinese connection, with the FTC tasked with enforcement.
- The three bills are aimed at addressing China’s exploitation of US data privacy and safeguarding data security. The proposals have TikTok directly in their sights and have been introduced as the Biden administration continues to review the national security implications of the platform.
- The House Energy and Commerce Committee’s innovation, data, and commerce subcommittee will review the three proposals and has made American competitiveness in the tech sector opposite China a priority.
